The rules of the workshop
These terms explain who may use St. Nick's List, how household and shared access works, and the responsibilities that come with using the service.
These Terms of Service (“Terms”) are an agreement between you and Baldwin Industries, an Ontario, Canada business, for access to St. Nick's List at stnickslist.com and its related services (“Service”). By creating an account, accepting an invitation, creating a guest identity, or otherwise using the Service, you agree to these Terms and our Privacy Policy.
If you use the Service for an organization or another legal entity, you represent that you can bind it. If you do not agree, do not use the Service.
We may limit or remove access when we reasonably believe an age, consent, or authority requirement has not been met.
You are responsible for activity through your authenticated account and for keeping your email account, devices, passkeys, recovery methods, and active sessions secure. Contact us promptly if you suspect unauthorized access. You may not share an account, impersonate another person, transfer authentication credentials, or bypass a required reauthentication step.
Account recovery and sensitive changes may require additional verification. We may refuse or delay a request when identity or authority cannot be established safely.
Household owners control membership and assign roles. Owners and guardians must have authority to create or manage profiles, addresses, preferences, and consent records for another person. Invitations must be sent only to intended recipients. Accepting an invitation joins the household with the role shown in the invitation.
Ownership transfer requires approval through the supported transfer flow. An owner may not close a household until responsibilities and dependent profiles are resolved as the Service requires. Removing a member or closing a household can end access immediately, but does not rewrite historical security, consent, or gift-coordination records that must remain attributable.
Guest management, guest recovery, household invitations, and giver links are bearer credentials. Anyone who possesses one may be able to use its scoped access until it is used, expires, reaches its use limit, or is revoked. Do not post these links publicly. If a link is exposed or sent to the wrong person, revoke it and issue a new one.
A guest is responsible for retaining the separate recovery link. We cannot reveal a readable copy of a lost secret. Claiming a guest membership requires a recently authenticated eligible account and does not grant access beyond the guest's existing role.
The Service separates recipient-facing list information from giver-only coordination. You agree not to use recipient access, another account, automated requests, page source, exports, or other means to discover reservations, purchases, contributors, or messages you are not authorized to see. We work to preserve surprises, but cannot guarantee that another user, merchant, notification, or out-of-band communication will not reveal one.
List entries, prices, merchant links, images, availability, and delivery estimates may be supplied by users or independent merchants and can be incomplete or wrong. A list is not a purchase contract, promise that a gift will be received, or endorsement of a merchant.
Gift exchange organizers are responsible for inviting the intended people, entering accurate constraints, and reviewing the participant list before drawing. A draw is private to its participant. An audited redraw revokes the previous assignments and attached private-list grants; participants should not rely on an assignment after the organizer announces a redraw.
Private kindness programs are optional household tools, not assessments of a person or promises about conduct. You must not use prompts or recorded moments to shame, rank, punish, diagnose, or publicly compare a child or adult. Household-authored prompts and reflections must be lawful, respectful, and suitable for everyone whose profile is involved. The Service deliberately does not provide public sharing, leaderboards, streaks, or photo uploads for this feature.
You retain ownership of content you submit. You give us a non-exclusive, worldwide, royalty-free license to host, encrypt, process, reproduce, adapt for technical display, and show that content only as needed to operate, secure, improve, and support the Service. This license ends when the content is deleted, except for backups, legal evidence, and content another authorized user independently controls.
You represent that you have the rights and permissions needed for the content and personal information you add. You must respect copyright, trademark, privacy, publicity, confidentiality, and other rights. We may remove or restrict content that violates these Terms or law.
You may not use the Service to:
Good-faith security reports should be sent to [email protected] and must avoid privacy violations, disruption, extortion, and public disclosure before we have had a reasonable opportunity to investigate.
Merchants and other external sites are independent from us. Their terms, prices, returns, warranties, delivery, availability, and privacy practices apply to your interaction with them.
St. Nick's List may earn a commission when you buy through retailer links. As an Amazon Associate we earn from qualifying purchases. Commissions never change which options we show or their order, and they do not increase the price you pay. When a page shows a link that can earn a commission, this disclosure appears above the first such link.
When you save an Amazon (amazon.ca or amazon.com) or eBay (ebay.ca or ebay.com) product link, we keep the product identifier (the Amazon ASIN or eBay item number) and the marketplace named by the link itself, not by where you or a giver are located. Links are shown as direct links to that retailer's own product page, with our Associates tag or eBay Partner Network campaign added only for a marketplace where we have an active account. Links are never routed through a St. Nick's List redirect. Amazon short links (amzn.to, a.co) are not followed; paste the full product address.
We do not show Amazon prices, availability, or product images from a saved link. A price or availability appears only when it comes from the retailer's official product API, with the date and time it was retrieved shown beside it, and Amazon data is not shown or kept once it is more than 24 hours old. Amazon product images are never stored. Prices and availability can change; the retailer's page at the time of purchase applies.
When someone follows a retailer link, we add one to an anonymous daily count of retailer, marketplace, whether the link could earn a commission, and which page it was on. That count has no account, list, item, address, or device information and uses no cookie.
If we offer a paid feature, its price, renewal terms, taxes, refund conditions, and payment processor will be shown before purchase. Additional purchase terms presented at checkout will become part of these Terms. Nothing here creates a charge by itself.
Group gifts use an independent payment processor and pay the connected organizer account under the contribution terms shown before checkout. Contribution state, refunds, disputes, deadlines, overfunding, and organizer eligibility are governed by that disclosed flow and applicable processor rules. St. Nick's List is not a bank, escrow service, charity, or guarantor of delivery, and contributors must not use group gifts for unlawful fundraising or cash transfers unrelated to the listed gift.
Referral links may be shared only with people who would reasonably welcome them. They may not be used for spam, deceptive redirects, self-referral, paid traffic arbitrage, or false claims of affiliation. The current referral program does not promise cash, credits, prizes, or other compensation.
We may improve, add, remove, or limit features and may perform maintenance. We will use reasonable care to avoid unnecessary disruption and to give advance notice of material changes when practical. The Service may occasionally be unavailable because of maintenance, security events, provider failures, emergencies, or circumstances beyond our reasonable control.
We do not promise that every merchant link, imported detail, reminder, notification, or surprise will always be timely, accurate, or available. Keep independent records for any gift, deadline, or purchase that is important to you.
You may leave a household or request account deletion through the available controls, subject to ownership, guardian, legal-hold, and safety requirements. We may suspend or terminate access when reasonably necessary to protect people or the Service, respond to law, investigate abuse, or enforce these Terms. Where appropriate, we will give notice and an opportunity to appeal or correct the issue.
On termination, your right to use the affected access ends. Provisions that by their nature should survive—such as ownership, permitted record retention, disclaimers, liability limits, dispute terms, and enforcement rights—continue to apply. Deletion is handled as described in the Privacy Policy.
The Service software, design, branding, and operator-created materials are owned by Baldwin Industries or its licensors and are protected by applicable intellectual property laws. These Terms grant you a limited, revocable, non-transferable right to use the Service for its intended personal or household purpose. They do not transfer ownership or authorize use of our names, marks, source code, or proprietary materials.
Feedback is voluntary. If you provide it, you allow us to use it without restriction or payment, but we will not publicly attribute it to you without permission.
To the extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not disclaim warranties, guarantees, or remedies that applicable consumer law says cannot be excluded.
To the extent permitted by law, Baldwin Industries and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, goodwill, data, gifts, opportunities, or business, arising from the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim or CAD $100.
These exclusions do not apply to liability that cannot lawfully be limited, including where applicable fraud, willful misconduct, gross negligence, or personal injury caused by negligence. Some jurisdictions do not allow particular exclusions, so part of this section may not apply to you.
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Ontario will have jurisdiction, except where mandatory consumer or privacy law gives you the right to bring a claim elsewhere. Before starting a formal claim, you and we agree to try in good faith for 30 days to resolve it by contacting the other party. This does not prevent urgent injunctive relief or a complaint to a regulator.
We may update these Terms to reflect service, safety, or legal changes. We will post the new version and effective date. For material changes, registered users will receive prominent notice and will be asked to accept the new version when required. We will not treat silence as consent where law requires an affirmative choice. If you do not accept a required update, you may stop using the Service and request deletion.
Family Plus is not on sale at this time, and every feature is currently free. The subscription terms below describe what will apply to a household that buys Family Plus once it is offered.
Family Plus is an optional annual subscription for one household. These subscription terms apply when an adult owner or organizer of a household buys it, and are accepted separately at checkout. Its current price, what it includes, and what stays free are shown on the Family Plus page and again before payment. Payments are processed by Stripe.
These Terms, the Privacy Policy, and any feature-specific terms shown to you are the entire agreement about the Service. If one provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a business transfer while preserving applicable rights. Headings are for convenience only.
Questions about these Terms may be sent to [email protected]. Privacy questions should be sent to [email protected].
